Triton or Treat!

1. GENERAL: Information on how to enter and Prizes form part of these terms and conditions. Submission of an entry is deemed acceptance of these terms and conditions.

2 PROMOTION PERIOD: Promotion begins at 9:00AM Australian Eastern Daylight Time ("AEDT") on 7 October 2022 and ends at 6:00PM AEDT on 31 October 2022 (“Promotion Period”).

3 ELIGIBILITY: The Promotion is only open to legal residents of the Australian Capital Territory and New South Wales, who are eighteen (18) years of age or older as at the commencement of the Promotion Period and are either a private individual or a business with an Australian Business Number (ABN) that has a fleet of less than twenty five (25) vehicles. Government entities and rental car customers are excluded from entry to the Promotion. The Promoter reserves the right at any time to require proof of eligibility in such form as it reasonably considers necessary. Officers, directors, and employees of the Promoter and its parent, subsidiary, and affiliate companies, and each of their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Promotion (together, "Promotion Entities"), and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such officers, directors, and employees, are not eligible to enter the Promotion.

4 HOW TO ENTER: To enter the Promotion, during the Promotion Period purchase a new Mitsubishi Triton vehicle from an official Mitsubishi dealer and enter your:
(a) personal details, including your email address;
(b) purchase details; and
(c) a copy of your sales contract,
via the entry form available from the official Mitsubishi dealer at the time of purchase.
There is a limit of one (1) entry per vehicle purchased. If the vehicle purchase is cancelled, entry to the Promotion is void. Incomplete, indecipherable or illegible entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.

5 VALIDITY OF ENTRIES: The Promoter reserves the right to verify the validity of entries and entrants (including an entrant's identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

6 PRIZES: The following three (3) prizes (together, "Prizes") will be awarded in the Promotion: First Prize: AU$8,000 worth of Genuine Mitsubishi Triton Accessories including fitment of the accessories to the winner's Triton vehicle at the Promoter's recommended retail price.
Second Prize: AU$4,000 worth of Genuine Mitsubishi Triton Accessories including fitment of the accessories to the winner's Triton vehicle at the Promoter's recommended retail price.
Third Prize: AU$2,000 worth of Genuine Mitsubishi Triton Accessories including fitment of the accessories to the winner's Triton vehicle at the Promoter's recommended retail price.

7 PRIZE DRAW: Three (3) winners (together, "Winners") will be selected at random by the Promoter from all eligible entries received during the Promotion Period at 9:00AM AEDT on 16 November 2022 ("Draw Date"), at the Promoter's office located at Mitsubishi Motors Australia New South Wales Head Office at Unit 1, 11-13 Orion Road, Lane Cove NSW 2066. The first prize winner will be drawn first, followed by the second prize winner and finally the third prize winner. The outcome of the draw is final and binding.

8 PRIZE CONDITIONS: The following conditions and exclusions apply to the Prizes:
(a) Subject to availability, and the value of the Prize won, the Winners will be able to select
the Genuine Mitsubishi Triton Accessories of their choice.
(b) Fitting of some Genuine Mitsubishi Triton Accessories may impact the installation of other Genuine Mitsubishi Triton Accessories.
(c) Prizes will be fitted to the Winner's Mitsubishi Triton vehicle at a Mitsubishi dealer agreed to between the Winner and the Promoter.
(d) The Prizes are non-refundable and non-transferable and no cash alternative is available.
(e) If a Prize (or part of a Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with an alternate Prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.

9 WINNER NOTIFICATION: The Winners will be notified by email within seven (7) days after the Draw Date with instructions on how to claim the Prize. Reasonable efforts will be made to contact the Winners, but it is the Winner’s responsibility to monitor their email account, including any spam or junk mail folder, for receipt.

10 CLAIMING THE PRIZE: The Winners must claim the Prize by contacting the Promoter in accordance with the instructions provided in the Winner’s notification within fourteen (14) days of the date of the initial notification. The Winners must provide all requested information to enable the Promoter to administer the relevant Prize. The Promoter reserves the right at any time to require proof of eligibility from Winners (including age and place of residence) as it reasonably requires.

11 UNCLAIMED PRIZES: A Prize will be taken to be unclaimed if the Promoter cannot, after making all reasonable inquiries, award the Prize to the Winner because the Winner cannot be located or the Winner has not claimed the Prize within 14 days of the notification email being sent to the Winner's email address. If required, an unclaimed prize draw may take place on 16 December 2022 at the same time and place as the original draw, subject to any directions from a regulatory authority.

12 DELIVERY OF PRIZES: The Promoter will liaise with the Winners to organise a mutually suitable date and time to have the relevant Prize fitted to the Winner's Triton Vehicle at an official Mitsubishi dealer.

13 WINNER LIST: Full Winners list to be posted on the Promotion’s website accessible on https://www.mitsubishi-motors.com.au/ once Winners have provided all requested information to enable the Promoter to administer the relevant Prize. By entering this Promotion, each entrant acknowledges that if they win, their name will be published on the Promotion's website.

14 PRIVACY: the Promoter collects your personal information in order to provide their products or services to you, handle or respond to your request, and otherwise facilitate their dealings and accomplish the purpose for which the information was submitted to them (including to manage the Promotion).
The Promoter may collect your personal information from third parties (such as Mitsubishi dealers, or market research companies acting on our behalf) that have collected it from you.
The Promoter may be unable to deal with your request, allow you to participate in the Promotion or provide you with products and services if you do not provide the personal information they request.
The Promoter may use your personal information for the purposes of direct marketing, and by providing the Promoter with your personal information you consent to the Promoter doing so. However, if you do not wish to receive marketing or promotional communications from the Promoter, please notify the Promoter using the contact details below or use the opt out mechanism provided in those communications.
The Promoter usually only discloses your personal information to authorised Mitsubishi dealers or agents, or contractors or subcontractors, for example motoring organisations providing roadside assistance. Generally, the Promoter is not likely to disclose your personal information to overseas recipients, however they may disclose your personal information to their related bodies corporate in Japan.
The Promoter's Privacy Policy (accessible on their website at www.mitsubishi- motors.com.au/privacy-policy) contains information about how you may access your personal information held by the Promoter and seek correction of such information. It also contains information about how you may complain about a breach of the Australian Privacy Principles and how the Promoter will deal with such a complaint.

15 RELEASE: To the fullest extent permissible by law, the Promotion Entities exclude all liability for any loss or damage of any kind arising from or in relation to the Promotion and each entrant’s participation in it and/or use of any Prizes. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void ("non- excludable guarantees"). Subject to the limitations in the preceding sentence, the sponsor excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom.

16 CANCELLATION OR VARIATION: If for any reason whatsoever beyond the reasonable control of the Promoter, the Promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify or terminate the Promotion.

17 DISPUTE RESOLUTION: If you have any feedback, questions, or complaints, contact the Promoter via their ‘Customer Support’ webpage at https://www.mitsubishi- motors.com.au/owners/contact-us.html. If you have a complaint, you agree to first contact Promoter's support team to attempt to resolve such complaint. If Promoter cannot resolve the dispute through their support team, you and Promoter agree that any dispute, claim, or disagreement arising out of or relating in any way to this Promotion, including any dispute, claim, or cause of action relating to any Prizes awarded in this Promotion, and including any dispute, claim, or cause of action arising out of or related to the interpretation or application of this disputes provision or these terms and conditions, including the enforceability, revocability, scope, or validity of this disputes provision, that cannot be resolved via the Promoter's customer support team, may be adjudicated by a court of competent jurisdiction located in the State or Territory in which the entrant resides.

18 GOVERNING LAW: The Promotion is governed by the laws of the State or Territory in which the entrant resides and the Commonwealth of Australia.

19 PROMOTER: The promoter is Mitsubishi Motors Australia Limited (ACN 007 870 395) of Unit 1, 11-13 Orion Road, Lane Cove West NSW 2066 ("Promoter").
